We respect your privacy and are committed to protecting it through our compliance with this Privacy Policy (the “Policy”).
This Policy sets forth:
- the types of information we may collect, or which you may be required to provide, when you download, install, register with, access, or use our APP; and
- our practices for collecting, using, maintaining, protecting, and disclosing that information.
This Policy applies only to information we collect in this APP, including any chat or other electronic communications in the APP.
This Policy DOES NOT apply to information that:
- we collect offline, in person, or in any other way; or
- you provide to, or is collected by, any third party and shared with us.
Please note that our website may also have a privacy policy with terms that are different than those found here. We strongly encourage you to read that policy.
Read this Policy carefully to understand our practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download or use this APP. By downloading, registering with, or using this APP, you agree to the terms of this Policy.
This Policy – and all of its terms – may change from time to time (see below). Your continued use of this APP after any revision of the Policy means you accept those changes. Our current version of the Policy will always be accessible to you within the APP. We will inform you of all material changes to the terms of this Policy via push notification. Please note that you will not be notified of any such changes if you disable the push notification feature. You will be bound by the terms of our updated Policy even if you have disabled push notifications and do not receive notice of our changes.
WHAT INFORMATION WE COLLECT AND HOW WE COLLECT IT
We collect information from and about users of our APP:
- directly from you when you provide it to us; and
- automatically when you use the APP.
INFORMATION YOU PROVIDE TO US
When you download, register with, or use this APP, we may ask you to provide information:
- by which you may be personally identified, such as name, address, email address, telephone number, social media account, or any other information we deem necessary and appropriate, including any other personal identifier by which you may be contacted; and
- that is about you but does not identify you, such as purchase history and location.
This information includes, but is not limited to, the following:
- information that you provide by filling out forms in the APP, contacting us, or by using any in-APP features (including chats, messaging, forum posts, and reviews) and that you provide at the time of downloading the APP, registering to use the APP, and using the APP in any way;
- your responses to surveys, questionnaires, polls, or similar tools that we may use for market and customer research purposes;
- details of transactions you carry out through the APP; and
- your search queries on the APP.
The APP may contain a “chat” or forum feature in which you may choose to provide information, photos, and communicate with us or other users of the APP (“User Contributions”). Your User Contributions are posted and transmitted to others solely at your own risk and Depot Deliveries cannot control – and expressly disclaims any responsibility for – the actions of any third parties, including other users, with whom you may choose to share your User Contributions or who may otherwise be able to view your User Contributions. We do not guarantee that your User Contributions will not be viewed by unauthorized persons, including the general public.
By providing User Contributions, you grant us, our affiliates, and service providers, the right to use, reproduce, modify, display, distribute, and otherwise disclose to third parties any such material, for any lawful purpose, without notice to you. We also reserve the right to remove any User Contributions as we determine in our sole discretion, for any reason.
AUTOMATIC INFORMATION COLLECTION/TRACKING
When you download, access, and use the APP, we may use technology to automatically obtain:
- Usage Details. When you access and use the APP, we may automatically obtain certain details of your access to and use of the APP, including traffic data, location data, and other communication data and the resources that you access and use on or through the APP. We do not store this information.
- Device Information. We may obtain information about your mobile device and internet connection, including the device’s unique device identifier, operating system, browser type, and mobile network information. We do not store this information.
- Location Information. This APP may obtain real-time information about the location of your device. We do not store this information.
INFORMATION COLLECTED BY THIRD PARTIES
When you download, register for, or use the APP, certain third parties may use automatic information collection technologies to collect information about you or your device.
These third parties may include:
- other apps;
- advertisers;
- analytics companies;
- your mobile device manufacturer; and
- your mobile service provider.
These third parties may use tracking technologies to collect information about you when you use this APP. The information they collect may be personal information as well as information about your online activities across different websites and apps. These third parties may use this information for advertising or other targeted content. We do not sell or otherwise disclose this information to any third parties, except as provided herein. Nor do we control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible party directly.
“DO NOT TRACK” DISCLOSURE
Depot Deliveries does not collect personal identifying information from your activities, conduct, and user history outside of the APP, except as otherwise disclosed herein.
HOW WE USE YOUR INFORMATION
We may use your information to:
- provide you with the APP and its contents, and any other information, products, or services that you request from us or that we may elect to offer to our APP users, including any changes or updates to the products and services offered;
- provide you with notices about your account;
- notify you when APP updates are available;
- fulfill any other lawful purpose, including but not limited to carrying out our obligations and enforcing our rights arising from any contracts entered into between you and us, including for billing and collection.
By using the APP, you are electing to receive promotional communications from Depot Deliveries, including push notifications and/or SMS messaging. You may opt-out from receiving those communications by disabling these features on your device.
DISCLOSURE OF YOUR INFORMATION
We may, in our sole discretion, elect to disclose certain information about our users, except as provided for herein. We may disclose personal information that we collect or you provide:
- to our subsidiaries, partners, associates, and affiliates in the ordinary course of business;
- to our employees, contractors, vendors, service providers, and other third parties we use to support our business, and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them;
- to a buyer, investor, partner, or successor, including in the event of a change in ownership, joint-venture, partnership, merger, acquisition, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Depot Deliveries’s assets;
- to fulfill any lawful purpose deemed appropriate by Depot Deliveries, including but not limited to the purpose for which you provide it and any other purpose disclosed by us in this Policy, as may be amended;
- to comply with any court order, law, or legal process, including to respond to any government or regulatory request;
- to enforce our rights arising from any contracts entered into between you and us, and for billing and collection;
- if we believe, in our sole discretion, that disclosure is necessary or appropriate to protect the rights, property, or safety of Depot Deliveries, our customers or others. This includes, but is not limited to, exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
Where appropriate, we contractually require these third parties to keep the disclosed information confidential and use it only for the purposes for which we disclose it to them.
YOUR RIGHTS ABOUT OUR COLLECTION, USE, AND DISCLOSURE OF YOUR INFORMATION
We strive to provide you with choices regarding the information you provide to us.
- Location Information. You can choose whether or not to allow the APP to collect and use real-time information about your device’s location. If you block the use of location information, some parts of the APP may become inaccessible or not function properly;
- Promotions and notifications. If you do not want to receive push notifications or SMS messaging from us, you may opt-out on your device.
California Users:
If you are a California resident, California law may provide you with additional rights regarding our use of your information. To learn more about your California privacy rights, visit https://oag.ca.gov/privacy/ccpa. California’s “Shine the Light” law (Civil Code Section 1798.83) permits users of our APP that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. OPT-OUT/UNSUBSCRIBE OPTION
Users of the APP have the option to elect not to receive communications, notifications, alerts, offers, and updates from us. Please note that deciding to opt-out or unsubscribe may change your user experience and the offerings available to you. To opt-out or unsubscribe, you may disable push notifications and text messaging for the APP on your device.
DATA SECURITY
Depot Deliveries takes your privacy seriously and has implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.
The safety and security of your information also depends on you. Where you have chosen a password for access to the APP, you are solely responsible for keeping this password confidential. We do not have access to your password. DO NOT SHARE YOUR PASSWORD WITH ANYONE. We urge you to be careful about giving out information in public areas of the APP, including chats and message boards, which are considered public.
Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure and, despite our efforts to protect your information, we cannot guarantee the security of the information transmitted through our APP. Any such transmission of information is at your own risk and Depot Deliveries disclaims any responsibility for the unauthorized disclosure of that information, including the circumvention of our data privacy and security measures.
As part of our security measures, we do not maintain your information for longer than we deem necessary. The length of time deemed necessary under this section may depend on various factors, including but not limited to, the nature of the information, its relevance to our business operations and offerings, industry standards, your use of the APP, and any other factors appropriate in making such a determination (including those mandated by federal, state, and local governments, agencies, and watchdogs).
INTELLECTUAL PROPERTY RIGHTS
The APP and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Depot Deliveries, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Our name, trade terms, logo, service names, designs, and slogans are trademarks of Depot Deliveries or its affiliates or licensors. You must not use such marks without our prior written permission.
This Policy permits you to use the APP for your personal, non-commercial use only. You are prohibited from reproducing, distributing, modifying, creating derivative works of, publicly displaying, republishing, or transmitting any protected material. By using the APP, you accept and agree that you will not engage in any activity prohibited herein unless permission is expressly granted by us to you in writing.
We take claims of copyright infringement seriously. We will respond to notices of alleged copyright infringement that comply with applicable law. If you believe any materials accessible in our APP infringe your copyright, you may request removal of those materials (or access to them) from the APP by submitting written notification to us at the contact information provided below. Per the Online Copyright Infringement Liability Limitation Act of the Digital Millennium Copyright Act (17 U.S.C. § 512), any such written notice must include substantially the following:
- your physical or electronic signature;
- identification of the copyrighted work you believe to have been infringed or, if the claim involves multiple works on the APP, a representative list of such works;
- identification of the material you believe to be infringing in a sufficiently precise manner to allow us to locate that material;
- adequate information by which we can contact you (including your name, address, telephone number, and email address);
- a statement that you have a good faith belief that use of the copyrighted material is not authorized by the copyright owner, its agent, or the law;
- a statement that the information in the written notice is accurate; and
- a statement, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
DISCLAIMER OF WARRANTIES
YOUR USE OF THE APP, ITS CONTENT, FEATURES, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE APP IS AT YOUR OWN RISK. THE APP, ITS CONTENT, FEATURES, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE APP ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER WE NOR ANY PERSON ASSOCIATED WITH US MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE APP, INCLUDING ALL INFORMATION, CONTENT, FEATURES, AND SERVICES CONTAINED THEREIN. WITHOUT LIMITING THE FOREGOING, NEITHER WE NOR ANYONE ASSOCIATED WITH US REPRESENTS OR WARRANTS THAT THE APP, ITS CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE APP WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR APP OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE APP OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE APP WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.
TO THE FULLEST EXTENT PROVIDED BY LAW, WE HEREBY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.
THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
LIMITATION ON LIABILITY
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL DEPOT DELIVERIES, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE APP, OR ANY CONTENT ON THE APP, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.
You agree to defend, indemnify, and hold harmless Depot Deliveries, its affiliates, licensors, and service providers, and its and all of their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Use or your use of the app, including, but not limited to, your User Contributions, any use of the app’s content, features, services, and products other than as expressly authorized in these Terms of Use, or your use of any information obtained from the app.
GOVERNING LAW AND JURISDICTION
Any dispute or claim arising from the APP or this Policy, or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the State of New Jersey without giving effect to any choice or conflict of law provision or rule.
Any suit, action, claim, complaint, or proceeding arising out of, or related to, the APP or this Policy shall be instituted exclusively in the federal or state courts of _____________, County of _____________. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
CHANGES TO OUR PRIVACY POLICY
We may update this Policy from time to time. We will inform you of all material changes to the terms of this Policy via push notification. Please note that you will not be notified of any such changes if you disable the push notification feature. You will be bound by the terms of our updated Policy even if you have disabled push notifications and do not receive notice of our changes.
The date this Policy was last revised is identified at the beginning of this Policy.
CHILDREN UNDER THE AGE OF 13
The APP is not intended for children under 13 years of age, and we do not knowingly collect personal information from children under 13. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us.
CONSENT BY USE OF THE APP
By downloading, registering with, or using this APP, you agree to the terms of this Policy. If you do not wish to accept the terms of this Policy, do not use the APP and delete it immediately.
